TERMS OF SALES

The general conditions of sale are to read carefully. They constitute the elements of the sales contract proposed by COULEURS in DESIGN. The order will only be taken into account when you have accepted these terms and conditions. The general conditions of sale govern the relations between COULEURS in DESIGN (SAS with capital of € 1,500), registered in Any COULEURS DESIGN customer acknowledges having read this document before signing an order with the word « good for agreement ». Any signature of an order implies acceptance of these conditions. Any national of the European Community and the countries respecting the directive 95/46 / CE can not assert his linguistic ignorance as clause of cancellation of the contract. COULEURS en DESIGN reserves the right to modify its conditions at any time. In this case, the conditions applicable to the buyer are those in force on the date of order of the customer.

Article 1: Website and Features of Articles The main purpose of the COULEURS DESIGN website is to provide information, pictures of paintings, accessories and services provided by the company. The size and price of the tables proposed for sale on the site are presented in the description of each table. However slight differences between the items presented online and the product delivered to the customer may exist (that is to say, shades of colors, small imperfections of wood and lacquer …), due to the fact of production handcrafted paintings and the type of wood used. Similarly and taking into account the conditions of photographic shooting as well as differences in the patinas rendering performed by the internet browser software and visualization monitors. The colors of the delivered items may have slight variations with those viewed online. These small differences, since they relate to non-determining characteristics and do not affect the quality of the tables, can not justify a cancellation of an order or a refusal of delivery. The tables presented on the site are not in stock, each order being the subject of a particular treatment. The tables will be produced only on the order with the condition of payment of a discount of 50% by transfer. The production of a panel order will be done after signature with the mention « good for agreement » and payment of a discount of 50% by transfer. You will express your commitment and your acceptance of these conditions of sale by signing the order validated by us. Therefore, the order will be firmly taken into account, which will definitely engage both parties. The deadlines for the production of the tables are mentioned for information on each order.

Article 2: Order Process Any order placed through the website will be validated and confirmed by sending an email containing the summary of the order, the place of delivery, the estimated date of shipment and method of payment. The order will be signed in two copies, each of the two parts will keep an authentic copy of its engagements. As a general rule, a deposit of 50% will be requested before any order is executed. Prior to any deliveries, the balance of 50% will be claimed once the table is completed. COULEURS en DESIGN reserves the right to cancel the order of a customer with whom there is a dispute over the payment of a previous order.

Article 3: Price and Payment The prices of tables are indicated in euros, include all taxes included in France and excluding delivery. As part of a purchase to a country outside France, all charges, local taxes, or customs duties, do not fall under COLORS in DESIGN and will be borne by the buyer. It is his responsibility to inform himself about the import conditions with the authorities of his country. COLORS in DESIGN reserves the right to modify them at any time, before the final validation of the order, especially in case of increase of the charges, the rate of VAT and in case of manifest error. The tables are billed at the current rate on the site at the time of final confirmation of the order by the customer. The prices do not include the costs of preparation and delivery of the order. These fees are calculated and added to the total amount of the order. The customer is informed of the amount of fees before the final validation of his order. The tables presented on the site are payable in two installments: 50% to the signed order and 50% as soon as the painting is finished before delivery. COLORS in DESIGN offers its customers to pay the order by bank transfer made to the bank account of COLORS in DESIGN whose references will be communicated at the time of validation of the order. The text of the transfer must include the order number and the name of the customer. The order will be reserved for three working days from the validation of the order form or signed quote. As soon as confirmation of the transfer is confirmed, the order will be put into production. Same for the delivery, which will be done after confirmation of the transfer. Failing receipt of the transfer within the time indicated or in case of default of payment, the order will be canceled.

Article 4: Delivery The information of production and delivery times will be communicated to the customer with a date which is between 21 days and 1 month upon receipt of payment. The deadline, costs and delivery conditions will be validated at the signing of the order. It’s elements take into account the production load, carrier availability and postal deadlines. COLORS in DESIGN undertakes to do everything necessary to deliver the ordered works within the indicated deadlines. But each order is the subject of a particular treatment, also the delivery times are only given as an indication. Possible delays can not justify the cancellation of the order or the claim for damages. COULEURS en DESIGN can not be held responsible for the consequences of late delivery. In case of payment by bank transfer the order will be treated only with effective receipt with an offset on the number of days corresponding. In any case, the tables are delivered after their full payment. The table will be delivered to the delivery address indicated by the Customer on the order. Upon delivery, the customer must check the following before the departure of the carrier / deliveryman: • the conformity of the goods received with those ordered; • absence of any apparent defect in tables. In case of non-compliance or apparent defect, the customer refuses the table specifying the reason for refusal on the carrier / deliveryman’s receipt. He does not sign the delivery note and returns the package to the carrier. The customer must immediately report (within 48 hours) the problem to COLORS in DESIGN with all the relevant supporting documents, either by email or by mail. In this case, the return costs will be borne by COULEURS en DESIGN or the carrier. If necessary, the latter will proceed as soon as possible, at the customer’s choice, to the exchange of this table or the refund Failure to comply with these formalities at the time of delivery, the tables will be deemed compliant and free from defects and no claim can be validly accepted by COLORS in DESIGN.

Article 5: Right of withdrawal From the date of the signing of the order, and in accordance with the legislation in force, you have a period of seven days to assert your right of withdrawal from COLORS in DESIGN. To do this, you must send us within this period (postmarked postmark) a registered letter with acknowledgment of receipt, indicating your intention to retract to the address of the company. The refund of the amount paid to the order will be made no later than thirty days after receipt of the letter. This provision applies only to individuals. Article 6: Cancellation, postponement, modification and return Apart from your right of withdrawal within seven days, any request for postponement or modification of order is subject to the agreement of COLORS in DESIGN. Article 7: Guarantees The COULEURS paintings and accessories in DESIGN benefit, in accordance with the legal provisions, from: • the legal guarantee of conformity. • the legal guarantee against hidden defects resulting from a material, design or manufacturing defect, affecting the products delivered and rendering them unfit for use. Any warranty is excluded in case of misuse, negligence, lack of maintenance on the part of the customer, as in case of normal wear of the property, accident or force majeure. The COULEURS guarantee in DESIGN is limited to the exchange with a table of the same value. The maintenance of the boards is done with a cloth very slightly wet for consequent tasks and normal cloth for the dust. No solvents or low alcohol products should be used.

Article 8: Intellectual Property The content of the site is protected by the provisions of the code of intellectual property. All models of paintings and photographs proposed by COULEURS in DESIGN are protected by copyright. The customer may not use, copy, reproduce, modify or distort these tables or its elements, including on the internet, without the prior written permission of COULEURS in DESIGN. The rights of the customer on the purchased board are therefore limited to a right of private use, excluding any right of representation and reproduction. All photographs, logos, texts and trademarks appearing on this site have been registered and are the exclusive property of COLORS in DESIGN. Any use in the form in particular of reproduction, modification, denaturation, transmission or distribution is forbidden and constitutes of counterfeit which can engage the civil and penal liability of its author. Article 9: Protection of personal data The information and data concerning the customers allow the correct management of the orders and the customer file. In accordance with the law, the customer has a right of access to the personal data concerning him and a right of rectification that it is sufficient for him to exercise by contacting COLORS in DESIGN. The website is designed to meet the expectations of its customers with all the necessary information. As such he regularly offers news. At any time, it is possible to no longer receive any of this information by visiting the site. Article 10: Applicable Law These general conditions of sale will be executed and interpreted in accordance with French law. The law applicable to our contractual relations with our customers is French law. In the event of disagreement between the parties, each will swear allegiance to resolve the dispute amicably. If the dispute persists, the competent court will be that of the headquarters of COULEURS in DESIGN.
